These terms govern the use of the valuation service offered on estimios.be. Among other things, they describe what we do with your contact details: they are passed to partner estate agencies, for a fee, and only if you consent to it.

The service provides a tool for estimating the market value of a residential property located in Belgium. It is free to use and requires no prior registration.
Using the service constitutes acceptance of these terms. If you do not accept them, do not use the service.
The tool produces an indicative valuation, together with a range. That valuation is the output of a statistical model applied to the characteristics you declare.
It is not:
The model learns from asking prices in listings, not from prices signed before a notary. No visit takes place: the actual condition, the aspect, nuisances and easements are not observed. For a value that holds against a third party, consult a chartered surveyor, a notary or an accredited property valuer.
The service is provided as is, with no warranty of availability or of accuracy.
Two clearly distinct sets, which do not follow the same path.
Municipality, street, floor area, number of rooms, condition, energy rating and other characteristics. They serve to compute your valuation, and the result appears on screen without you having to supply anything.
These characteristics leave your device in one case only. If you request an on-site valuation, they travel with your contact details to the partner: without them, it could not answer you usefully (§ 4). In every other case, they serve to compute your valuation and nothing else.
We ask for them only at the moment you request an on-site valuation, and only what that request requires: first name, surname, email address and telephone number, because an agency will call you back. We also keep the date and time of your consent and the version of these terms accepted: that is what makes the consent demonstrable, as the GDPR requires.
The data controller is Brain Technology. The legal basis is your consent, within the meaning of GDPR article 6.1.a.
This is the most important point in this document, and we would rather set it out plainly.
The service is free to you because it is funded by our partners. When you request an on-site valuation and tick the consent box, you authorise Brain Technology to pass your contact details and the characteristics of the property valued to one or more partner estate agencies, and to receive a fee for doing so — each introduction is paid to us per unit, whatever happens afterwards.
This box conditions nothing else, and it is the only consent we ask for. The valuation, the range, the breakdown of the calculation and the price differences all appear without it. It is asked for only because the transfer is necessary to the service you have just requested: making a service conditional on a consent it does not need would render that consent not freely given, and therefore invalid (GDPR, art. 7.4).
In practice:
Without that consent, no data is passed to anyone. You may withdraw it at any time: write to hello@nextbrain.be. Withdrawal takes effect for the future; it does not undo transfers already made, but you may approach the partner concerned directly to ask for erasure.
We neither sell nor pass on your data to parties outside this framework: no ad network, no data broker, no list reseller.
The journey has two levels, and the second is optional. You may stop at the first, which asks for nothing.
Under the GDPR you have the right of access, rectification, erasure, restriction, objection and portability, as well as the right to withdraw your consent at any time. Send your request to hello@nextbrain.be.
You may lodge a complaint with the Belgian Data Protection Authority, rue de la Presse 35, 1000 Brussels.
The estimates and the figures published on this site rest on tens of thousands of publicly accessible properties, combined with official Statbel data. No raw data and no identifiable property is republished.
Third-party brands and sites are mentioned for information only. Estimios is affiliated with no listings portal.
The interface, the texts, the illustration and the statistical model are protected. You may use the service for your own personal purposes. Any systematic extraction, reproduction or commercial reuse of the content is prohibited without prior written agreement.
Since the valuation is indicative and rests on information you declare, Brain Technology cannot be held liable for decisions taken on that basis alone, nor for differences between the valuation and an actual sale price.
We are not answerable for the services rendered by the partners, with whom you enter into a separate contractual relationship should the case arise.
These terms may change. The version that applies is the one published on this page at the time of your use. The date of the latest update appears at the top of the document, and the version accepted is kept with your consent.
These terms are governed by Belgian law. In the event of a dispute, and failing an amicable settlement, the courts designated by the Belgian Judicial Code shall have jurisdiction. If you are acting as a consumer, the rules of jurisdiction that protect you apply in any event.
